First Class (JMFC) J R Ghadge on Saturday directed senior Police Inspector of
Sitabuldi Police Station Satyajit Bandiwar and Investigating officer (IO) PSI K
R Gavai to appear before the court and give written explanation as to what led
them to breach the landmark verdict of the Supreme court in the case of Arnesh
Kumar versus State of Bihar.
According to Harishwar Mendhre, Sitabuldi cops tore his shirt at Rani Jhansi Square for not wearing helmet while riding a two-wheeler. Following the humiliation, a heated exchange of words took place between the cops and Mendhre. The cops took Mendhre to Sitabuldi Police Station and booked him under Sections 353, 332 and 294 of IPC. PSI Gawai, who is the IO in the case, immediately arrested the accused which amounts to violation of Apex Court’s verdict in the said case. Supreme Court had stated in the judgement that police officers shall not arrest persons without recording specified reasons under the Code of Criminal Procedure, when such offences are punishable with a term of seven years or less. Mendhre experienced a nightmare on Diwali as he spent the entire day and night in the police station.
When Mendhre was produced before the vacation remand judge on Saturday, Adv Aakash Gupta representing the accused, filed an application on record along with the Apex Court ruling demonstrating the illegalities committed by the police that invited attention of the court.
The State was represented by PP Hukrey. Adv Amol Darekar also appeared for the accused.
